Schwab & Stroope represents owners, developers, contractors, subcontractors, engineers, and suppliers involved in the construction industry. We believe that careful negotiation and drafting of agreements, and thoughtful risk mitigation strategies and tools, are key to making our clients’ work successful. Nevertheless, when controversies arise, we are also zealous advocates.

We have experience both as in-house corporate counsel at public and private engineering and construction companies and as litigation counsel in private practice at major law firms. Our biographies

David Schwab

Partner

David is a founding member and partner at Schwab & Stroope, PLLC. He has practiced law in the US and internationally for nearly 30 years, and he represents contractors, owners, engineers, and suppliers on a wide range of energy, industrial, and infrastructure projects. He has advised clients on petrochemical, power generation, liquified natural gas (LNG), nuclear, offshore, and renewable energy matters. With a litigation background, David often represents clients on disputes involving breach of contract, warranty, force majeure, performance, payment, change order, schedule, and liquidated damages controversies.

David also counsels clients on transactional matters such as negotiating and structuring contracts, partnership agreements, MSAs, risk mitigation strategies, federal government contracting, compliance, and procurement activities. As the former Senior Vice President, General Counsel & Corporate Secretary of a nationally recognized EPC company (where he oversaw the company’s legal, risk, commercial management, government affairs, and compliance functions), David provides outside general counsel services to clients.

David’s deep knowledge and experience allows him to help his clients anticipate risks, protect their interests, and meet their business objectives.

Marc Stroope

Partner

Marc has almost 20 years of experience in the field of construction law and is among the first lawyers in Texas to become Board Certified in Construction Law by the Texas Board of Legal Specialization.

His practice involves representing owners, developers, contractors, and engineering firms in drafting, negotiating, and advising clients on a wide variety of engineering, procurement, and construction related agreements including traditional oil and gas, liquified natural gas (LNG), nuclear energy, and renewable energy projects.

Marc was previously Assistant General Counsel of a nationally recognized EPC company, where he supported multiple business groups from contract signing through the execution of project, as well as advised management across the company regarding corporate affairs and licensing issues. Before working as in-house counsel, Marc was a partner and trial attorney at a large law firm where he prosecuted and defended complex multi-party cases before state and federal courts in multiple jurisdictions. His background as a construction law litigator makes him keenly aware of the significance of the agreements which form the foundation of any construction project.

Marc served on the State Bar Committee on Pattern Jury Charges (Business, Consumer, Insurance, and Employment Volume) for ten years and chaired the Construction Pattern Jury Charges subcommittee.
